Abigail Sellers’s practice is focused on complex and intellectual property litigation, with an emphasis on high-stakes patent litigation. Abby has experience handling matters in federal court and California state court, in front of the Patent Trials and Appeals Board and in the pre-litigation stage. Abby's patent cases have spanned a variety of industries, including pharmaceuticals, medical devices and various other biotechnologies.

Abby maintains an active family law pro bono practice and has experience with both probate guardianships and adoptions.

Abby earned her J.D. from USC Gould School of Law, where she was elected Order of the Coif and was the editor in chief of the Southern California Law Review. Among other honors, Abby was the two-time recipient of the Arthur Manella Prize (first in class after both first and second year) and recipient of the Law Alumni Award (first in class after third year).

Abby obtained her B.S. in Biochemistry and B.A. in Spanish Linguistics from Arizona State University, where she was Phi Beta Kappa.

Experience

  • Foresight Diagnostics Inc. v. Personalis Inc. (PTAB). Represented Foresight Diagnostics, an early-stage precision medicine company, in IPR petitions brought by Foresight against Personalis after Personalis accused Foresight of patent infringement in District Court. Abigail helped obtain a favorable settlement for Foresight after the PTAB issued its first set of final written decisions, which found in Foresight’s favor on all grounds and invalidated every challenged claim.
  • Conformis, Inc. v. DePuy Synthes (D. Del.). Defended DePuy Synthes, an industry leader in orthopedic devices, in a patent litigation suit brought by Conformis.
  • Xiros, Ltd. v. DePuy Synthes (W.D. Tex./D. Mass.). Defended DePuy Synthes, an industry leader in orthopedic devices, in a patent litigation suit brought by Xiros.
