Litigation: Irell is dedicated to representing policyholders in highly complex insurance matters. We have deep background dealing with matters against insurers in state and federal courts across the country, as well as in arbitration proceedings. Business entities and individuals involved in complex business litigation often retain us to identify and assist them in pursuing coverage under policies of commercial general liability insurance, professional liability insurance, property insurance, fidelity and crime insurance, EPLI policies, LPL policies, directors and officers liability insurance (including A-side DIC policies), cyber liability insurance, and umbrella and excess liability insurance. We also have extensive experience at both the trial and appellate levels.
Professional Liability Matters: Clients have retained us to investigate and pursue claims against insurance brokers for errors or omissions in connection with the sale or issuance of insurance policies. We have also defended insurance brokerage firms against malpractice claims. We also represent other attorneys and law firms in the defense of legal malpractice claims relating to insurance and reinsurance matters. Our successes are again confidential, but we did obtain summary judgment for a leading international law firm on claims that the firm’s alleged professional negligence resulted in $20 million in damages.
Evaluation, Negotiation and Enforcement: Clients frequently seek our guidance in evaluating whether they have sufficient insurance protection against loss and liability before losses occur or claims have been asserted. Our experience includes negotiating and enforcing agreements involving self-insured retentions, minimum premium arrangements, captive insurance and reinsurance programs, multiple employer trusts, group and association agreements, and similar arrangements.
